Welcome to PhlebotomyPrep Mastery (the "App"), provided by PhlebotomyPrep Mastery ("we", "us", or "our"). By creating an account, accessing, or using the App, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the App.
The App is an educational tool designed to help users prepare for phlebotomy certification examinations through practice quizzes, study guides, flashcards, and related learning materials. The App is provided for personal, non-commercial educational study purposes only. We may modify, suspend, or discontinue any feature of the App at any time without notice.
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
The App offers paid access tiers that unlock additional study content. When you purchase a plan, access to the paid features is granted for a period of three (3) months from the date of purchase (the "Access Period"). Upon expiration of the Access Period, your access to paid features will be automatically revoked unless you purchase a renewal. Fees are charged in advance on a one-time basis per Access Period through our third-party payment processor (Base44 Payments / Wix Payments). All fees are non-refundable except where required by applicable law.
Because the App delivers digital educational content that is immediately accessible upon purchase, all sales are final and fees are non-refundable. If you believe you were charged in error, please contact us within fourteen (14) days of the charge. Statutory consumer refund rights in your jurisdiction remain unaffected where they cannot be waived.
You agree not to: (a) use the App for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorized access to any part of the App, its systems, or another user's account; (c) share, resell, or transfer your account or paid access to any third party; (d) copy, redistribute, or republish any App content; (e) use automated scripts, bots, or scrapers to extract content; or (f) interfere with the proper functioning of the App. Violations may result in immediate termination of your account without refund.
All content available through the App, including quizzes, study guides, flashcards, diagrams, text, graphics, and software, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
The App is a study aid and does not constitute medical advice, clinical instruction, or professional certification. Completing the App's content does not guarantee that you will pass any certification examination. The App is not affiliated with, endorsed by, or connected to any certifying body. You should always consult official certification guidelines and qualified instructors for authoritative information.
Your use of the App is also governed by our Privacy Policy. We handle personal and health-related information in accordance with applicable data protection laws. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT STUDY CONTENT IS ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We may suspend or terminate your account and access to the App at any time, with or without cause, and without notice. Upon termination, your right to use the App ceases immediately. Paid access that is terminated due to a violation of these Terms is not eligible for a refund. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall remain in effect.
We may revise these Terms from time to time. The most current version will be posted within the App with the updated date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App provider is established, without regard to its conflict of law principles. You agree to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising out of or relating to these Terms or the App.
